Try calling paypal directly via their 800 number, a customer service agent maybe able to assist you with filing a claim even though the time has passed. Just let them know the information from your payment and inform them that you have been trying to work with the seller but you are tired of their lies and enough is enough. I'm sure they will be able to do something. It would have been best to file the claim prior to your 45 day expiry but I guess its not your fault that you didnt know that they had a poor track record.
