I'm not sure I see how you could cover trademarks with a marker. They are molded into the receiver/barrel/body of the gun and are raised or recessed lettering/logos.

Some trademarks are illegal in the US and some are fine. Those airsoft manufacturers that license the trademarks (like CA does with Armalite) are legal. Those airsoft makers that do not pay royalties (like TM's with Colt trademarks) are in violation of copyright law and are illegal.
