The only issue was that this place really does commercial work only, so it wasn't a real contract, he just took it on and said he would put it in with other work. I have emails though showing our agreements.

Well that's different..

obviously you should bet your $35 back .. but as there was no contract and it was a cash deal for parts going in on another run .. you are pretty much pooched as if you push it.. your buddy in the shop will likely loose his job for doing side jobs with company equipment.
